West Virginia DTC wine shipping requirementsCan a winery ship wine directly to consumers in West Virginia?Yes — An out-of-state winery, farm winery, wine supplier or wine RETAILER licensed and in good standing in its domicile state may obtain a West Virginia direct shipper's license and ship wine to WV residents 21 or older for personal use. Note the unusually broad eligibility: West Virginia is one of the few states whose DTC channel is open to out-of-state RETAILERS as well as producers. Scope is wine only — no distilled spirits, no nonintoxicating beer. Volume limits apply; the exact cap is in the table below. Permit required

Yes — but it is a LICENCE, not a permit, and it is only one of at least six registrations. A WV direct shipper must hold: (1) the ABCA direct shipper's licence; (2) a West Virginia business registration number from the Tax Commissioner; (3) registration with the WV Secretary of State if a corporation/LLC/limited partnership (Certificate of Authority); (4) a federal TTB basic permit under the Federal Alcohol Administration Act; (5) TTB Special Occupation Tax registration (TTB F 5630.5d); and (6) separate ABCA WINE BRAND REGISTRATION for every brand before any shipment. It must also supply a Letter of Good Standing from the WV State Tax Department AND from its domicile state, and a copy of its current home-state wine licence.

Licence

Direct Shipper's License. West Virginia never calls it a permit. The statute and ABCA's FAQ both use 'direct shipper's license' (W. Va. Code §60-8-6a is titled 'Direct shipper's license'); on the current application form, ABCA Form ABCA-WS-3W (Revised 08/2024), the licence type checkbox is labelled 'Direct Wine Shipper'. Publish 'Direct Shipper's License (ABCA Form ABCA-WS-3W, 'Direct Wine Shipper')' so an applicant can find the box on the form.

Application fee

$150 or $250 per year for a direct shipper's licence, and the tier BASIS is stated two different ways by two current WV sources. Statute (§60-8-3(b) and §60-8-6a(a)(2)) splits by PRODUCT CLASS: $150 'for a licensee who sells and ships only wine' and $250 'who ships and sells wine, nonfortified dessert wine, port, sherry, or Madeira wines'. The current ABCA application form ABCA-WS-3W (rev. 08/2024) splits by ABV: '$150 to ship <14% ABV' OR '$250 to ship >14% ABV'. A third route exists for a winery or farm winery that wants to act as its own supplier, retailer and direct shipper — the Multi Capacity licence, which §60-8-3(b) and the current form both price at $350/yr, while §60-8-6a(a)(2) still says $300. NO $100 operational fee applies to direct shippers. Fees are prorated: an application submitted January 1 – June 30 pays one-half the licence fee. Volume cap

Two cases of wine per month to any one person, where West Virginia defines a case volumetrically: 'A case is defined as any combination of packages containing not more than nine liters of wine.' The cap is therefore 18 LITRES per person per calendar month, and it is package-agnostic — the limit is on volume, not on bottle count or format. No annual per-consumer cap, no producer-size tier, and no statewide aggregate cap on the shipper was located. Wine must be for the adult resident's 'personal use and consumption and not for resale'.

Sales tax

true — and the sales tax is only one of THREE taxes the direct shipper must collect from the West Virginia consumer and remit. §60-8-6a(b)(7) requires payment of 'all sales taxes, municipal taxes and the liter tax'. Sourcing is destination-based by statute: taxes are 'to be calculated as the sales were made in West Virginia at the location where delivery is made'.

State sales-tax rate

6% — the general West Virginia consumers sales and service tax rate. There is no separate wine, alcohol or DTC sales-tax rate. WARNING: 6% is NOT the total ad valorem burden on a WV DTC wine sale. A municipal wine tax of up to 5% of the invoice (W. Va. Code §8-13-7) and, in 119 municipalities, a 1% municipal sales and use tax stack on top — so an in-town delivery can carry roughly 12% ad valorem plus the per-litre excise.

Excise tax

Yes — the West Virginia LITER TAX under §60-8-4, owed by the direct shipper on wine sold and shipped to WV residents, reported under oath and paid monthly. Since July 1, 2021 HARD CIDER is carved out of the liter tax and carries its own separate tax under §60-8A-3, which also names direct shippers.

Excise rate

WINE: 26.406 cents PER LITRE ($0.26406/L) — W. Va. Code §60-8-4, 'a tax of twenty-six and four hundred six-thousandths cents per liter'. HARD CIDER: 22.6 cents PER GALLON — W. Va. Code §60-8A-3, 'a tax of 22.6 cents per gallon, in like ratio for any partial gallon or other unit of measure', with a producer credit of 5.6 cents per gallon on the first 100,000 gallons for producers of 250,000 wine gallons or less a year, tapering where production exceeds 150,000 gallons. West Virginia states its two wine-family excise rates in two DIFFERENT units; record each as written and do not normalise them.

Shipment reports

Monthly, and it is the same filing as the tax return — one monthly return, submitted to BOTH the ABCA Commissioner and the Tax Commissioner, due before the 16th of the following month. Required contents per ABCA: the consumer's name and address, date of sale, quantity sold, CARRIER, taxes collected, and a detailed invoice copy of every sale or shipment of wine into West Virginia. §60-8-6a(b)(6) states the statutory minimum as 'the total of wines, by type, sold and shipped into West Virginia for the preceding month'.

Record retention

Two years. W. Va. Code §60-8-7 requires every person who sells or ships wine as a direct shipper to WV adult residents to 'maintain records of all sales, shipments and deliveries, including invoices, records, receipts, bills of lading and other pertinent papers required by the commissioner. All such records shall be preserved for at least two years.' ABCA's Direct Shipper FAQ repeats the same two-year period verbatim. Records must be produced INSIDE West Virginia on demand, even if kept out of state.

Product registration

Required — and it is a paid, per-brand, pre-shipment filing that the guide's bare 'Required' does not price. ABCA's Wine Brand Registration instructions: 'All brands must be registered with the West Virginia Alcohol Beverage Control (WVABCA) Commissioner prior to any sales or shipment of wine to or into West Virginia', and 'The wine brand registration fee is $100 per brand for a three-year period.' One brand per application (Form WV W-100 / ABCC-WS-1-D, rev. 6/6/2025, under W. Va. Code §60-8-28); each label under the brand must be listed with its TTB ID, and a copy of the TTB Certificate of Label Approval plus an unattached physical label or colour photocopy must accompany it. Separately, §60-8-6a(a)(7) requires a list of all brands to be shipped to be filed with the LICENCE application.

Approved carriers

West Virginia publishes no approved-carrier list and approves no carrier by name. The requirement is structural and is stated identically in the statute and in ABCA's FAQ: 'All shipments of wine into West Virginia by licensed direct shippers shall be made by a LICENSED AND BONDED shipping carrier' (W. Va. Code §60-8-6). The carrier must also (a) not deliver into dry or local option areas, (b) obtain a written or electronic signature from an adult it verifies is 21 or older, and (c) refuse to complete the delivery if it cannot. The carrier must be named on the shipper's monthly return.

Regulator

West Virginia Alcohol Beverage Control Administration (WVABCA), an agency of the West Virginia Department of Revenue — for licensing, brand registration and the monthly return. A SECOND agency is mandatory, not optional: the West Virginia State Tax Department / Tax Commissioner takes the business registration number, receives the same monthly return, and receives the remittance of sales tax, municipal tax and liter tax.
